These Terms and Conditions ("Terms") govern your use of the website located at www.resistancestrength.fit and any services provided by First 13 Athletics, LLC, doing business as Resistance Strength and F13 Performance (collectively "Resistance Strength," "we," "us," or "our"). By accessing or using our website, signing up for our services, or opting in to receive text messages from us, you agree to be bound by these Terms.

Eligibility

You must be at least 18 years old to use our website, sign up for services, or opt in to receive text messages. If you are signing up on behalf of a minor, you confirm that you are the parent or legal guardian and that you accept these Terms on the minor's behalf.

Our Services

Resistance Strength operates a fitness facility located at 4630 Broadway in Allentown, Pennsylvania, offering:

• 24/7 open gym membership access through our mobile app and door system.
• F13 Performance coached classes, athletic training, and custom programming.
• One-on-one personal training services.
• Related products and services described on our website or in member agreements.

Specific membership terms, billing cycles, cancellation policies, and facility rules are governed by the membership agreement you sign when you enroll. In the event of a conflict between these Terms and your signed membership agreement, the membership agreement controls with respect to your membership.

SMS Text Messaging Program

By providing your mobile phone number and checking the consent boxes on our contact form, you agree to receive SMS or MMS text messages from Resistance Strength.

We operate two separate text message programs, each requiring its own opt-in:

• Transactional messages regarding service notifications, account updates, and appointment reminders.
• Marketing messages regarding membership information and promotional offers.

Message frequency varies based on your activity and the program you have opted in to. Message and data rates may apply based on your wireless carrier's plan. Resistance Strength is not responsible for any charges from your wireless carrier. All automated messages will be sent from a single business phone number associated with Resistance Strength.

To stop receiving messages, reply STOP to any message from us. You will receive one final confirmation message and then no further messages from that program. To opt back in later, contact us using the information at the bottom of this page or use the consent checkboxes on our website.

Carriers, including but not limited to AT&T, T-Mobile, Verizon, and US Cellular, are not liable for delayed or undelivered messages.

Acceptable Use

You agree not to:

• Attempt to gain unauthorized access to our website, our internal systems, or any other user's information.
• Interfere with or disrupt our website or services.
• Submit false, misleading, or fraudulent information through any form on our website.

Physical training involves inherent risks of injury. By using our facility, classes, or services, you assume all risks associated with exercise and fitness activities. Specific assumption of risk, waiver, and release terms are contained in the membership agreement you sign when you enroll. Nothing in these Terms supersedes or modifies the terms of that signed agreement.

Disclaimers

Our website and services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

Limitation of Liability

To the maximum extent permitted by law, Resistance Strength, its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, services, or SMS messaging program. Our total liability for any claim arising from these Terms or your use of our website or services will not exceed the amount you have paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Resistance Strength and our owners, officers, employees, and agents from any claim, loss, liability, damage, or expense arising from your use of our website or services, your violation of these Terms, or your violation of any law or third-party right.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or your use of our website or services will be brought in the state or federal courts located in Lehigh County, Pennsylvania, and you consent to the exclusive jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of our website or services after we update the Terms means you accept the revised Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
